Abstract

U radu se pobliže obrađuju odredbe hrvatskog zakonodavstva, u korelaciji sa međunarodnim i europskim pravnim izvorima, koje uređuju odgovornost prijevoznika za smrt i tjelesne ozljede putnika u cestovnom prometu. Zbog iznimne važnosti zaštite putnika, razmatrat ćemo i važnost unapređenja uloge osiguratelja, poglavito kroz ukazivanje na bitnost sklapanja ugovornih osiguranja (ugovor o prijevozu-prijevoznička odgovornost), pored osiguranja od automobilske odgovornosti kao obveznog osiguranja te njihove uloge u prometnom pravu. Cilj svake uređene države današnjice je težnja da se u što većem opsegu pruži sveobuhvatna zaštita putnika kroz osguranja jer se time smanjuje pritisak na državne fondove i ujedno, pruža zaštita gospodarskog interesa prijevoznika.

Abstract (english)

In this master's thesis, I (author) will elaborate law regulations (domestic law regulations) in correlation with international and european law regarding the liability of the carrier in case of death and bodily injury to passengers. Going towards, because of the great importance in favour of passengers protection, we'll also discuss the importance of insurer and insurance company, especially trough contracting alongside obligatory insurance and their role in transport law. Goal of every modern state nowadays is to provide the best possible care for passengers via insurance so that some of the pressure can be reduced from state fonds and at the same time, give more support and protection of interst to transport carriers.
