Abstract

Prekoračenje nužne obrane je institut o kojem ne možemo pričati bez same nužne obrane. Nužna obrana nam služi kao odskočna daska kako bi se sveobuhvatno objasnilo prekoračenje nužne obrane. U ovom radu su predočene sastavnice prekoračenja nužne obrane kroz sudsku praksu te ocjena i kažnjavanje za istu. Pomno su obrađena četiri slučaja te su u njima jasno ukazane razlike između ekscesivnog i intenzivnog prekoračenja. Također su prikazane instance ublažavanja kazne i isključenja krivnje radi postojanja ispričavajućeg razloga jake razdraženosti ili jake prepasti. Velika je težina, od situacije do situacije, opravdano i ispravno reagirati u obrani te svaka nova situaciju zahtijeva razradu svih okolnosti. U takav intelektualan napor dolaze sudovi i kroz svoje odluke daju nam jasan put praćenja teorijske vrijednosti instituta. Ovaj rad se maksimalno približava vrijednosti prakse u shvaćanju pravno postavljenog instituta.

Abstract (english)

Excess of necessity defence is a legal concept which we are unable to grasp without starting with necessity defence. It is a pillar for wholesome understanding of the excess of necessity defence. This thesis demonstrates integral elements of the excess of necessity defence through judicial practise, as well as its asessment and penalty. Special focus is given to four cases that are thouroughly elaborated and that give a clear point between the diferrent types of excesses. They also highlight the existence of exculpatory reasons which result in more lenient punishment or the exclusion of guilt. It is with great difficulty that justified defence can be executed in each seperate occasion. Also, all the various nuances of cases need to be meticulously researched in order to be able to render a verdit. That intellectual task falls on to judges whose rulings are our guidelines in understanding theoretical worth of the legal concept.
