Abstract

U ovom radu obradit će se tema impeachmenta kao instrumenta političke odgovornosti s naglaskom na njegovu primjenu u Sjedinjenim Američkim Državama. U prvom dijelu obradit će se sam pojam impeachmenta, njegov razvoj, pregled njegove zastupljenosti u zemljama u svijetu te kakav utjecaj ima na političke sustave. U drugom dijelu započinje se s pregledom položaja impeachmenta u zakonodavnom okviru Sjedinjenih Američkih Država te analizom samog postupka. Nadalje se razrađuju najznačajniji postupci impeachmenta američkih predsjednika od kojih je zadnji onaj Donalda Trumpa. Nastavno na zadnje obrađen slučaj impeachmenta, u posljednjem dijelu rada obradit će se trenutni sudski postupci koji se vode protiv bivšeg predsjednika Sjedinjenih Američkih Država, a koji ujedno predstavljaju prve slučajeve podizanja optužnice protiv nekadašnjeg predsjednika, kako na državnoj tako i na federalnoj razini.

Abstract (english)

This thesis deals with impeachment as an instrument of accountability with an emphasis on its application in the United States of America. The first part will deal with the very concept of impeachment, its development, an overview of its representation in countries around the world, and what impact it has on political systems. The second part begins with an overview of the position of impeachment in the legislative framework of the United States of America and an analysis of the procedure itself. Furthermore, the most significant impeachment procedures of American presidents, the latest of which is that of Donald Trump, are elaborated. Continuing from the last case of impeachment, the last part of the paper will deal with pending criminal cases against the former president of the United States of America, which also represent the first cases of indictment against the former president, both at the state and federal level.
