Abstract

Ovaj rad bavi se uređenjem stranih subvencija u europskom pravu tržišnog natjecanja. Navodi se definicija stranih subvencija iz relevantnih europskih izvora prava i uspoređuje s pojmom državnih potpora te iznosi problematika stranih subvencija u kontekstu tržišnog natjecanja. Fokus je rada prikaz uređenja sadržanog u Uredbi (EU) 2022/2560 Europskog parlamenta i Vijeća od 14. prosinca 2022. o stranim subvencijama kojima se narušava unutarnje tržište („Uredba o stranim subvencijama“) te u manjoj mjeri, odredaba Sporazuma o subvencijama i kompenzacijskim mjerama WTO-a i Uredbe (EU) 2016/1037 Europskog parlamenta i Vijeća od 8. lipnja 2016. o zaštiti od subvencioniranog uvoza iz zemalja koje nisu članice Europske unije („Antisubvencijska uredba EU-a“), a navode se i drugi povezani izvori prava te obrađuje njihov odnos s Uredbom o stranim subvencijama. Sektorski sporazumi i izvori prava koji uređuju specifične gospodarske sektore nisu detaljnije obrađeni.

Abstract (english)

This paper deals with the regulation of foreign subsidies in European competition law. The definition of foreign subsidies from relevant European law sources shall be cited and compared with the concept of state aid and the issues of foreign subsidies in the context of competition shall be presented. The focus of the paper is an overview of the provisions contained in Regulation (EU) 2022/2560 of the European Parliament and of the Council of 14 December 2022 on foreign subsidies distorting the internal market (the “Foreign Subsidies Regulation“) and, to a lesser extent, the arrangements of the WTO Agreement on Subsidies and Countervailing Measures and Regulation (EU) 2016/1037 of the European Parliament and of the Council of 8 June 2016 on protection against subsidised imports from countries not members of the European Union (the “EU Anti-Subsidy Regulation“). Other related sources of law shall be mentioned and their relationship with the Foreign Subsidies Regulation shall be addressed. Sectoral agreements and sources of law governing specific economic sectors are not addressed in more detail.
