Sažetak | Psihičko maltretiranje na radnom mjestu staro je koliko i ljudski rod i ljudski rad. Mobing kao društvenu pojavu, sada u sudskoj praksi prihvaćen standard, pokušali su identificirati i definirati još sedamdesetih, a onda intenzivnije osamdesetih godina prošlog stoljeća, no u nas još uvijek ne postoji usvojena zakonska definicija mobinga, iako je široko rasprostranjena pojava čije se posljedice odražavaju ne samo na pojedinca, njegov zdravstveni i socijalni status, nego i na njegovo okruženje, radnu sredinu, i fenomen je koji je potrebno promatrati s medicinskog, psihološkog, sociološkog i pravnog aspekta. U prvom dijelu rada bit će ukratko riječi o pravu osobnosti i ljudskom dostojanstvu, poveznicama svih izloženih cjelina ovog rada, s aspekta mobinga, diskriminacije i uznemiravanja. Ukratko ću prikazati definicije diskriminacije i uznemiravanja, kako bih što jasnije u glavnom dijelu rada pokušao približiti značenje mobinga, etimologiju, pokušaje definiranja, problematiku, njegove vrste, faze, uzroke, posljedice i prevenciju. U završnom dijelu rada bit će riječi o tome kako je u hrvatskom zakonodavstvu uređena zaštita od mobinga, odnosno koja su pravna sredstva na raspolaganju žrtvi mobinga, gdje je radi učinkovite pravne zaštite nužno povezati odredbe Zakona o radu i Zakona o obveznim odnosima. |
Sažetak (engleski) | Psychological harassment in the workplace is as old as the human race and human work. Mobbing as a social phenomenon, now an accepted standard in judicial practice, was tried to be identified and defined in the seventies, and then more intensively in the eighties of the last century, but there is still no adopted legal definition, even though it is a widespread phenomenon whose consequences reflect not only on the individual, his health and social status, but also on his environment, working environment, and is a phenomenon that needs to be observed from a medical, psychological, sociological and legal perspective. In the first part of this paper, there will be a brief discussion of personality rights and human dignity, that connect all presented units of this work, from the aspects of mobbing, discrimination and harassment. I will briefly present the definitions of discrimination and harassment, in order to try to define the meaning of mobbing, etymology, attempts to define it, problems, its types, stages, causes, consequences and prevention as clearly as possible in the main part of the paper. The final part is about how protection against mobbing is regulated in Croatian legislation, i.e. what legal protections are available to victims of mobbing, when, for effective legal protection, it is necessary to combine the provisions of the Labor Act and the Civil Obligations Act. |
