Istražuju se temeljni propisi koji podupiru zaštitu računalnih programa, te djelovanja institucija koje su od presudne važnosti za globalnu usklađenost prava intelektualnog vlasništva. Unutar Europske unije, temeljna načela autorskog prava čine osnovu zaštite računalnih programa, a u radu se analizira način na koji su ti propisi implementirani u hrvatski pravni sustav. Uz pravni okvir, rad detaljno analizira definiciju računalnog programa, njegove ključne komponente i njegovog značaj za tehnološke inovacije. Komparativno istraživanje kontinentalnog i anglosaksonskog pravnog sustava ističe glavne razlike u pristupima zaštiti računalnih programa, posebice u odnosu na autorsko pravo, patentno pravo i zaštitu poslovnih tajni. Rad također istražuje razlike između tradicionalnih računalnih programa i modernih modela softvera kao usluge, uz razmatranje pitanja intelektualnog vlasništva, licenciranja, odgovornosti i zaštite osobnih podataka. Posebno se ističe rastući utjecaj umjetne inteligencije na prava intelektualnog vlasništva, s naglaskom na pravne izazove koje donosi autonomno stvaranje sadržaja od strane umjetne inteligencije. Na kraju, rad nudi pregled ključnih smjernica za unaprjeđenje zakonodavstva, kako bi se odgovorilo na dinamične izazove koje donose nove tehnološke inovacije vezano za računalne programe i umjetnu inteligenciju.
Abstract (english) The paper analyzes of the legal framework regulating the protection of computer programs at the international and national levels, with a special focus on the Croatian legal system. The fundamental regulations that support the protection of computer programs are explored, as well as the activities of the institutions that are of crucial importance for the global harmonization of intellectual property rights. Within the European Union, the fundamental principles of copyright form the basis of the protection of computer programs, and the paper analyses the way in which these regulations have been implemented in the Croatian legal system. In addition to the legal framework, the paper analyses in detail the definition of a computer program, its key components, and its significance for technological innovation. A comparative study of the continental and Anglo-Saxon legal systems highlights the main differences in approaches to the protection of computer programs, especially in relation to copyright, patent law, and the protection of trade secrets. The paper also explores the differences between traditional computer programs and modern software-as-a-service models, with a consideration of issues of intellectual property, licensing, liability, and the protection of personal data. The growing impact of artificial intelligence on intellectual property rights is particularly highlighted, with an emphasis on the legal challenges posed by autonomous content creation by artificial intelligence. Finally, the paper offers an overview of key guidelines for improving legislation to respond to the dynamic challenges posed by new technological innovations in computer software and artificial intelligence.
