Abstract

Pravo na pošteno suđenje zajamčeno je čl. 6. st. 1. Europske konvencije za zaštitu ljudskih prava i temeljnih sloboda, a u nacionalnom pravnom poretku, Ustavom Republike Hrvatske dok se jamstvo nadzora zakonitosti pojedinačnih akata upravnih tijela i tijela koja imaju javne ovlasti, osigurava putem upravnog spora.
Europski sud za ljudska prava vrši nadzor nad provedbom prava iz Europske konvencije za zaštitu ljudskih prava i temeljnih sloboda.
U radu su prikazani uloga i načela postupanja Europskog suda za ljudska prava, te objašnjeni aspekti prava na pošteno suđenje koji su grupirani prema njihovoj povezanosti u predmetima, a također i pretpostavke za primjenu čl. 6.st.1.
U posljednjem dijelu rada su primjeri europske i nacionalne sudske prakse u području upravnog spora.

Abstract (english)

The right to a fair trial is guaranteed under Art. 6. P. 1 of the European Convention for the Protection of
Human Rights and Fundamental Freedoms, in the national legal system the Constitution of the Republic of
Croatia ensures the said rights to be guaranteed and protected, while the guarantee of supervision of the
legality of individual acts of administrative bodies and bodies with public powers is ensured through an
administrative dispute.
The European Court of Human Rights supervises the implementation of rights recognized European
Convention for the Protection of Human Rights and Fundamental Freedoms.
The paper presents the role and principles of the European Court of Human Rights and describes the aspects
of the right to a fair trial, which are grouped based on their connection in the cases, and it explains the
preconditions to the exercise of Art. 6. paragraph 1.

And the last part aims to present The European Court of Human Rights case law as well as national judicial
practice arisen in the field of administrative dispute.
