Abstract

Ovaj diplomski rad bavi se postupkom utvrđivanja građevne čestice u pravnom poretku Republike Hrvatske, koji je reguliran prvenstveno Zakonom o prostornom uređenju. Građevna čestica utvrđuje se rješenjem, a postupak uključuje i razmatranje pravnog interesa koji ističe razlike između privatnog i javnog interesa.
Prvi dio rada obrađuje prostorne planove, rješenje o utvrđivanju građevne čestice te pravni interes u postupku utvrđivanja građevne čestice. Drugi dio rada posvećen je analizi odluke Ustavnog suda U-III-5095/2017, kojom je usvojena ustavna tužba. Na kraju rada razmatra se sudska praksa Europskog suda za ljudska prava, upravnih sudova i Visokog upravnog suda Republike Hrvatske, s ciljem pružanja sveobuhvatnog uvida u pravne aspekte postupka utvrđivanja građevne čestice.

Abstract (english)

This paper deals with the procedure for determining a building plot within the legal system of the Republic of Croatia, which is primarily regulated by the Physical Planning Act. The building plot is determined by a courts order, and the procedure includes the consideration of legal interests that highlight the differences between private and public interests.
First part of the paper addresses physical plans, the decision on determining the building plot, and the legal interest in the procedure of determining the building plot. The second part of the paper is dedicated to the analysis of the Constitutional Court decision U-III-5095/2017, which accepted the constitutional complaint. The final part of the paper examines the case law of the European Court of Human Rights, Administrative Court and the High Administrative Court, with the aim of providing a comprehensive insight into the legal aspects of the procedure for determining a building plot.
