Abstract

Predmet ovog rada bili su materijalni nedostaci robe s pretežitim naglaskom na situacije kod trgovačke kupoprodaje te odgovornost za njih. Naglašava se aktualnost ovog pravnog instituta u današnjoj trgovini dobrima. Na početku se daje uvid i određuju polazne točke u definiranju materijalnih nedostatak. Kroz rad se upoznaje pravna klasifikacija materijalnih nedostataka te pretpostavke za odgovornost. Rad nas uvodi i u zakonodavni okvir predviđen za digitalno poslovanje koje je sve više prisutno u trgovini. Na kraju se razmatraju i neki posebni slučajevi odgovornosti za materijalne nedostatke. Kroz cijeli rad naglašavaju se situacije koje su posebno određene za trgovačku kupoprodaju. Autor na kraju daje svoj zaključak o uređenju ovog instituta.

Abstract (english)

The subject of this paper was material defects of goods, with a particular focus on situations in sales transactions and liability for them. The emphasis is on the topicality of this legal institute in today's trade in goods. At the beginning, an insight is given and starting points are determined in defining material defects. Through the work, the legal classification of material defects and the prerequisites for liability are introduced. The paper also introduces us to the legislative framework provided for digital business, which is increasingly present in trade. Finally, some special cases of liability for material defects are considered. Throughout the work, situations that are specifically defined for sales transactions are emphasized. The author concludes by giving his own conclusion on the regulation of this institute.
