Abstract

U ovom diplomskom radu obrađivano je pravo na uvid u spis predmeta u kaznenom postupku. Prvenstveno se obrađivao međunarodni normativni okvir prava na uvid u spis kroz pregled Europske konvencije o ljudskim pravima u okviru Vijeća Europe te Direktive 2012/13/EU o pravu na informiranje u kaznenom postupku. Kako bi dojam bio potpun konzultirana je sudska praksa Europskog suda za ljudska prava kao i Suda Europske unije. Nakon što se u radu analizirala nadnacionalna razina, koncentracija je prešla na unutarnje (domaće) uređenje prava na uvid u spis u kaznenom postupku. Kroz Zakon o kaznenom postupku te Poslovnik državnog odvjetništva dan je zanimljiv pregled na koji način je hrvatski zakonodavac transponirao prethodno spomenute međunarodne dokumente u svoj vlastiti pravni poredak i uređenje.
Kao najbitnije presude koje su analizirane u ovom diplomskom radu izdvojili bi za potrebe ovog sažetka presudu Europskog suda za ljudska prava Dolenec protiv Republike Hrvatske, kao i presude hrvatskih sudova koje su pokazatelj da se ovo jedno od bitnijih prava obrane u kaznenom postupku poštuje.
Pravo na uvid u spis kaznenog predmeta je zasigurno temelj pravičnog postupka pred nadležnim tijelima i u ovom diplomskom radu je istaknuta njegova važnost za okrivljenika i branitelja.

Abstract (english)

In this master's thesis, the right to inspect the case file in the criminal procedure was examined. The focus was primarily on the international normative framework of the right to inspect the case file through a review of the European Convention on Human Rights within the framework of the Council of Europe and Directive 2012/13/EU on the right to information in criminal proceedings. In order to provide a comprehensive overview, the case law of the European Court of Human Rights and the Court of Justice of the European Union was consulted. After analyzing the supranational level in the thesis, attention shifted to the internal (domestic) regulation of the right to inspect the case file in the criminal procedure. Through the Criminal Procedure Act and the Rules of Procedure of the State Attorney's Office, an interesting overview was provided of how the Croatian legislator transposed the aforementioned international documents into its own legal order and framework.
The most important judgments analyzed in this master's thesis include the judgment of the European Court of Human Rights in the case of Dolenec against the Republic of Croatia, as well as judgments of Croatian courts that serve as indicators that this significant right of defense in criminal procedure is respected.
The right to inspect the case file in a criminal matter is undoubtedly the foundation of a fair proceeding before competent authorities, and this master's thesis emphasizes its importance for the accused and their defense.
