Abstract

Osnovni cilj ovog rada je utvrditi pojam neovisnog suda kroz teorijske podjele prava na neovisan sud i sudsku praksu. U ovom radu predstavljena je praksa Europskog suda za ljudska prava i praksa hrvatskih sudova. Na osnovu teorijskih podjela i sudske prakse predmeti Europskog suda za ljudska prava su grupirani u četiri skupine: utjecaj politike na neovisnost sudstva, utjecaj na neovisnost suda unutar samoga sustava sudstva, funkcioniranje suda kao neovisnog tijela u odnosu na zakonodavnu i izvršnu vlast, narušenje dojma neovisnosti. Važna je uloga Europskog suda za ljudska prava u očuvanju vrijednosti demokratskog društva i vladavine prava jer svojim presudama djeluje preventivno u svrhu otklanjanja povreda Europske konvencije za zaštitu ljudskih prava i temeljnih sloboda. Bitno je naglasiti da je prvenstvena uloga Europskog suda za ljudska prava donošenje presuda temeljem specifičnih okolnosti slučaja, a ne donošenje apstraktnih sudova.

Abstract (english)

The main goal of this paper is to determine the concept of an independent court through the theoretical division of the right to an independent court and judicial practice. This paper presents the practice of the European Court of Human Rights and the practice of Croatian courts. On the basis of theoretical divisions and judicial practice, the cases of the European Court of Human Rights are grouped into four groups: the influence of politics on the independence of the judiciary, the influence on the independence of the court within the judicial system itself, the functioning of the court as an independent body in relation to the legislative and executive authorities, the violation of the impression of independence. The role of the European Court of Human Rights in preserving the values of a democratic society and the rule of law is important because it acts preventively with its rulings in order to eliminate violations of the European Convention on Human Rights and Fundamental Freedoms. It is important to emphasize that the primary role of the European Court of Human Rights is to make judgments based on the specific circumstances of the case and not to make abstract judgments.
