Abstract

Ovaj rad pruža analizu razvoja obveze informiranja. U početnim fazama pojavljuje se kao kategorija moralne dužnosti, dok se kroz dvadeseto stoljeće uzdiže na razinu formalno-pravne obveze uz pomoć utjecaja načela savjesnoti i poštenja. Primarna funkcija ovog istraživanja je definirati opseg i značaj obveze predugovornog informiranja te pravne posljedice njenog nepoštivanja. Rad također sadržava komparativnu analizu načina na koji se engleski i francuski sustav obračunavaju s problematikama predugovorne obveze informiranja. Važnost adekvatnog informiranja osobito se naglašava u osvrtu na potrošačko pravo s obzirom na osjetnu asimetriju informacija između trgovca i potrošača. Studija dodatno osvjetljava izazove u primjeni ovih standarda u hrvatskom pravnom kontekstu, posebno u svjetlu očekivanja Europske Unije.

Abstract (english)

This study provides an analysis of the evolution of the duty to inform. In its initial stages, it appears only as a moral category. However, over the course of the twentieth century it rose to the importance of a specific legal requirement. The primary purpose of this study is to define the borders of the pre-contractual duty to provide information and the legal ramifications of failing to adhere to it. The paper also includes a comparative analysis of how the English and French systems address the issues of pre-contractual duty to inform. The importance of adequate information is particularly emphasized in the context of consumer law, given the noticeable information asymmetry between the trader and the consumer. The study further illuminates the challenges in applying these standards in the Croatian legal context, especially in light of the expectations of the European Union.
