Abstract

U radu je dan pregled izrade jedinstvenog jugoslavenskog Zakonika o sudskom postupku u građanskim parnicama iz 1929. godine. Stvaran u nestabilnim političkim i društvenim prilikama koje su, uz izraženi pravni partikularizam, obilježile razvoj Kraljevine SHS (1918 – 1929), Zakonik je važio za jedan od kohezivnih faktora jugoslavenskog društva. A propos unifikacije prava, proklamirani parlamentarizam već je 1921. doživio svojevrsnu degradaciju jer je donošenje jedinstvenih zakona Vidovdanski ustav de facto prepustio zakonodavnom odboru, a narodnoj skupštini ostavio samo mogućnost glasovanja o prijedlozima en bloc. Pojedini jedinstveni zakoni, međutim, donijeti su tek nakon proglašenja tzv. Šestosiječanjske diktature 1929. kada je primat monarhističkog uređenja i formalno potvrđen. Osim što su česti sukobi i političke smjene na vlasti usporile donošenje Zakonika, proces njegove izrade pokazao je postojanje dva različita pravna sistema. Srpski Zakonik iz 1865. godine zasnivao se na načelima svojstvenima srpskoj pravnoj tradiciji koju su srbijanski pravnici htjeli i očuvati. Primjerice, najviše se raspravljalo oko zabrane dokazivanja spornih činjenica pomoću svjedoka u parnicama u kojima vrijednost predmeta spora prelazi 2 000 dinara. S druge strane, pravnici iz ostalih dijelova monarhije težili su preuzeti načela iz austrijskog Zakonika o sudskom postupku iz 1895. Njegov tvorac, profesor Franz Klein, promatrajući parnicu kao institut javnog dobra, izmislio je postupak u kojem sudac upravlja parnicom u svrhu utvrđivanja materijalne istine, suprotno od stranačkog upravljanja parnicom koje je prevladavalo u zakonicima iz 19. st. Austrijski model upravljanja parnicom u praksi je doprinio bržem, lakšem i jeftinijem postupku te su ga preuzeli mnogi kasniji zakoni, uključujući jugoslavenski iz 1929. Iz tih razloga, u radu je uz proces izrade Zakonika i polemika oko određenih instituta, poseban osvrt stavljen i na Kleinov novi model postupka.

Abstract (english)

The thesis gives an overview of the drafting of the unified Yugoslav 1929 Code of Court Procedure in Civil Litigations. Created in the unstable political and social conditions that, along with expressed legal particularism, characterized the development of the Kingdom of SCS (1918 – 1929), the Code was considered one of the cohesive factors of Yugoslav society. A propos of the unification of laws, the proclaimed parliamentarism already experienced a kind of degradation in 1921, because the Vidovdan Constitution de facto left the adoption of unified laws to the Legislative Committee, and left the National Assembly only the option of roll call voting about proposals. Some unified laws, however, were adopted only after the promulgation of the so-called 6 January dictatorship in 1929, when the primacy of the monarchist system was formally confirmed. In addition to the fact that frequent conflicts and political changes of government slowed down the adoption of the Code, the drafting process showed the existence of two different legal systems. The Serbian Code of 1865 was based on the principles inherent in the Serbian legal tradition, which Serbian lawyers wanted to preserve. For example, the most discussed question was the prohibition of proving contentious facts using witnesses in litigations in which the value of the subject matter of dispute exceeds 2 000 dinars. On the other hand, lawyers from other parts of the monarchy tended to adopt the principles from the Austrian Code of Civil Procedure of 1895. Its creator, Professor Franz Klein, observing litigation as an institution of public good, invented a procedure in which a judge manages litigation for the purpose of searching for the material truth, which is contrary to the party´s management of litigation that prevailed in the laws of the 19th century. The Austrian model of the management of the litigation in practice contributed to a faster, easier and inexpensive procedure and was later adopted by many laws, including the 1929 Yugoslav one. For these reasons, in addition to the process of drafting the Code and the polemics surrounding certain institutes, a special reference was put on Klein's new procedural model as well.
