Abstract

Poligraf je uređaj čija je svrha pomoć u pronalasku počinitelja. Postupak provođenja poligrafskog testiranja i poligrafske metode važan su dio dobivanja adekvatnih rezultata tih ispitivanja kao i prisutstvo stručno osposobljene osobe ispitivača, odnosno poligrafista. Uz kratki povijesni razvoj nastanka poligrafa kakvog poznajemo danas, rad naglašava i njegov budući razvoj primjene umjetne inteligencije i ostalih oblika modernih tehnologija. Njegova primjena u radu je posebno naglašena u Republici Hrvatskoj gdje rezultati poligrafskog ispitivanja ne predstavljaju dokaz, odnosno ne mogu se prilagati kao dokaz tijekom kaznenog postupka. Uporaba poligrafa i njegovih rezultata provode se od strane policije te predstavlja pomoćno sredstvo tijekom provođenja izvida kaznenih djela. Stav hrvatskih sudova o uporabi poligrafa obrađen je u radu s obzirom na postojeću sudsku praksu. Uloga i primjena poligrafa različito je uređena među državama te se u radu pruža prikaz s obzirom na određene države Europe, Kanade, Sjedinjenih Američkih Država i Japana.

Abstract (english)

A polygraph is a device whose purpose is to provide help in finding the right offenders. Polygraph testing procedure and polygraph methods are an important part of obtaining adequate results of the polygraph tests, as well as the presence of a professionally trained examiner, polygraphist. In addition to the brief historical development of the polygraph as we know it today, the paper emphasizes its future development with the rise of artificial intelligence and other forms of modern technologies. In this paper use of polygraph is particularly emphasized in the Republic of Croatia, where the results of the polygraph test cannot be submitted as evidence during criminal proceedings. The use of the polygraph and its results are carried out by the police officers and it is an auxiliary tool during the investigation of criminal acts. The position of Croatian courts on the use of polygraphs is elaborated in the paper based on existing court practice. The role and application of the polygraph is regulated differently among other countries, and the paper provides an overview with regard to certain countries in Europe, Canada, the United States, and Japan.
