Abstract

Stare uzance o građenju donijete su 1977. U međuvremenu su se dogodile značajne promjene stoga je zakonodavac ovlastio HGK i HUP da utvrde nove uzance. Objavili su ih u prosincu 2021. i izgledno je da su okolnosti COVID vremena imali pretjerani utjecaj na njihov sadržaj. Niz odredbi ide na štetu naručitelja, a u korist komornih članova od kojih je najneobičnija ona koja se tiče nepromjenjivosti cijena. Od drugih važnijih promjena ističu se uzance o ugovornoj kazni i produljenju rokova. U radu je dano mišljenje o suglasnosti s kogentnim zakonskim normama uzanci o izmjeni cijene, nepromjenjivosti cijene, ključu u ruke i personalnoj primjeni. Za kraj je raspravljen odnos Posebnih uzanci o građenju i međunarodnih običaja, a s naglaskom na FIDIC.

Abstract (english)

Old special usages in construction date from 1977. In the meantime significant changes occurred because of which legislator authorized HGK and HUP to codify new special usages. They were published in December of 2021 and it seems that circumstances of COVID age had an impact on its content. Many regulations go against the employer and benefit chamber members, the most unusual of which is the one concerning fixed prices. Among more important changes, the provisions on contractual penalties and extension of deadlines stand out. In the paper, an opinion is given on the conformity of the special trade usages about price changes, fixed prices, turnkey and a scope of personal application with mandatory legal norms. At the end was discussed the relationship between the Special usages in construction and international customs, with an emphasis on FIDIC.
