Abstract

U radu se analizira važnost založnog prava i njegovi pravni učinci. S obzirom da su nerijetki slučajevi kada nije moguće naplatiti tražbine, založno pravo vrlo je često prisutno u praksi. Rad započinje prikazom osnivanja založnog prava i navođenjem dva najčešća oblika založnog prava. Konkretno, govori se o dobrovoljnim založnim pravima. Zatim se u središnjem dijelu pažnja posvećuje fazi osiguranja. Također se analizira i druga navedena faza, faza namirenja. Navodi se i sudska praksa u Republici Hrvatskoj, povezani slučajevi sa temom rada. U zaključku se sumiraju analize navedenih dijelova i temeljem toga izvodi se zaključak o bitnosti postojanja založnog prava i prednostima koje ono za založnog vjerovnika predstavlja.

Abstract (english)

The paper analyzes the importance of the right of lien and its legal effects. Considering that there are quite a few cases when they cannot collect the claims, the right of lien is very often present in practice. The paper begins with a description of the establishment of the right of lien and stating the two most common forms of the right of lien. In particular, voluntary liens are discussed. Then, in the central part, attention is paid to the insurance phase. The second mentioned phase, the settlement phase, is also analyzed. Judicial practice in the Republic of Croatia is also cited, cases related to the topic of the paper. In the conclusion, the analyzes of the mentioned parts are summarized and based on this, a conclusion is drawn about the importance of the existence of the right of lien and the advantages it represents for the lien creditor.
