Abstract

Rad pruža analizu prava ispitanika na pristup osobnim podacima prema članku 15. Opće uredbe o zaštiti podataka. Ističe se značaj transparentnosti i kontrole nad podacima te izazovi s kojima se ispitanici mogu suočiti. Kroz pregled pravnih odredbi, mišljenja, smjernica te pojedinih presuda Suda Europske unije i nacionalnih sudova rad pruža uvid u zaštitu privatnosti i ostvarivanje prava ispitanika u digitalnom dobu. Rad započinje analizom definicije osobnog podatka, budući da osobni podatak predstavlja predmet prava na pristup. Glavni dio rada analizira tekst članka 15. Opće uredbe za zaštitu podataka kako bi se razumjela njegova svrha, osnovna načela i pravila koja reguliraju pravo na pristup podacima. Ističu se ključni aspekti prava pristupa, kao što su pružanje kopije podataka, informacije o obradi te obavijesti vezane uz međunarodne transfere. Također, razmatraju se i prava i obveze ispitanika i voditelja obrade u vezi s ostvarivanjem ovog prava.

Abstract (english)

The thesis provides an analysis of the data subject's right to access personal data according to Article 15 of the General Data Protection Regulation. The importance of transparency and control over data and the challenges that data subject may face are emphasized. Through an overview of legal provisions, opinions, guidelines and individual judgments of the Court of the European Union and national courts, the thesis provides an insight into the protection of privacy and the exercise of the rights of data subjects in the digital age. The thesis begins with an analysis of the definition of personal data, since personal data is the subject of the right of access. The main part of the thesis analyzes the text of Article 15 of the General Data Protection Regulation in order to understand its purpose, basic principles and rules governing the right to access data. Key aspects of the right of access are highlighted, such as the provision of a copy of data, processing information and notices related to international transfers. Also, the rights and obligations of the data subject and the data controller in connection with the exercise of this right are considered.
