Abstract

Rad se bavi mjerom oduzimanja imovinske koristi i drugim srodnim institutima u kaznenom postupku. Početni dio orijentiran je na povijesni razvitak, te najvažnije međunarodne ugovore u borbi protiv organiziranog kriminala. U središnjem dijelu rada prikazano je uređenje mjera oduzimanja i proširenog oduzimanja imovinske koristi, mjere privremenog osiguranja u hrvatskom zakonodavstvu, te njihova primjena u sudskoj praksi. Zaključno je napravljena paralela sa stranim zakonodavstvima i osvrt na cjeloukupno uređenje mjere s naglaskom na njezine nedostatke.

Abstract (english)

This paper is dealing with the measure of confiscation of material benefits and other related institutes in criminal proceedings. The initial part is oriented towards historical development and the most important international treaties in the fight against organised crime. The main part of the paper shows the regulation of measures of confiscation and extended confiscation of pecuniary gain, measures of temporary insurance in Croatian legislation, and their application in case law. In conclusion, a parallel was made with foreign legislation and a review of the overall regulation of the measure with an emphasis on its shortcomings.
