Abstract

Kondemnacija prije dospjelosti tražbine odnosi se na iznimke od pravila prema kojemu sud može naložiti izvršenje određene činidbe samo ako je ona dospjela do zaključenja glavne rasprave. Te iznimke podrazumijevaju slučajeve kada sud prihvati zahtjev za uzdržavanje, presudu kojom se tuženik obvezuje na predaju ili preuzimanje stvari dane u najam ili zakup i prije prestanka tih odnosa, tužbu vjerovnika za donošenje presude prije dospjelosti tražbine na temelju dokazanog pravnog interesa, pravičnu novčanu naknadu buduće neimovinske štete te kamate. Osim u slučaju tužbe vjerovnika prije dospjelosti tražbine na temelju čl. 186.c Zakona o parničnom postupku (ZPP), pravni interes tužitelja se presumira jer se temelji na zakonskom ovlaštenju, odnosno sudskoj praksi. U slučaju podnošenja tužbe prema čl. 186.c ZPP-a taj pravni interes tužitelj mora posebno dokazati. U radu je istražena praksa hrvatskih sudova u povodu svake iznimke te je zaključeno kako je u određenim slučajevima praksa sudova redovna dok su neki slučajevi vrlo slabo zastupljeni. Tako u povodu uzdržavanja i kamata redovno se donose kondemnatorne presude prije dospjelosti tražbine dok kod odnosa iz najma i zakupa te pravične novčane naknade praksa sudova je neujednačena. Za tužbu prema čl. 186.c ZPP-a iznimno je važna uloga na sucima i njihovom tumačenju zakonskih odredbi ali i konkretnih činjenica u svakom slučaju. Ovrha na temelju kondemnatorne presude prije dospjelosti tražbine ne bi se mogla tražiti prije dospijeća same tražbine

Abstract (english)

Condemnation before the maturity of the claim refers to exceptions to the rule according to which the court can order the execution of a certain act only if it became mature until closure of the hearing. These exceptions include cases when the court accepts a request for maintenance, a judgment binding the defendant to hand over or take over things given for rent or lease before the termination of those relations, the plaintiff complaint for judgment before the maturity of the claim on the basis of a proven legal interest, fair monetary compensation in the future non-property damages and interests. Except in the case of a condemnatory complaint before the maturity of the claim based on Article 186.c of the Croatian Code of Civil Procedure (ZPP), the plaintiff's legal interest is presumed because it is based on legal authority or court practice. In case of filing a lawsuit under Article 186.c of the ZPP, the plaintiff must prove his legal interest. In this work it is investigated the practice of Croatian courts in the context of each exception, and it was concluded that in certain cases the practice of the courts is regular, while some cases are very poorly represented. In the case of maintenance and interest, condemnation judgments are regularly passed before the maturity of the claim, while the practice of the courts is uneven in relation to rent and lease and fair monetary compensation. Judges and their interpretation of legal provisions and concrete facts in each case play an extremely important role
