Abstract

I) Radni se odnosi u zakonodavstvu Republike Hrvatske normativno uređuju Zakonom o radu (lex generalis), sklopljenim i Ustavom usklađenim međunarodnim ugovorima te drugim podzakonskim aktima. Tijekom trajanja radnog odnosa postoji mogućnost nastupa ozbiljnih i teških okolnosti zbog kojih jedna od stranaka ugovora o radu smatra da ugovor o radu treba prestati, a nastale su okolnosti takve da od stranke nije razumno očekivati nastavak izvršavanja prava i obveza predviđenim ugovorom do prestanka istog istekom otkaznog roka. Predmet ovog rada jest upravo institut izvanrednog otkaza ugovora o radu, dok je cilj rada prikazati posebnosti vezane uz izvanredni otkaz ugovora o radu. U prvom se dijelu rada pozornost usmjerava na zakonom propisane načine prestanka ugovora o radu, dok se u drugom dijelu rada pozornost usmjerava na jedan od načina prestanka ugovora o radu – otkaz. Nadalje, treći dio rada nudi pregled karakteristika izvanrednog otkaza ugovora o radu pri čemu se pozornost usmjerava na zakonsko uređenje tog instituta, okolnosti pod kojima izvanredni otkaz o radu postaje zakonit te postupak izvanrednog otkaza. Također, u tom se dijelu rada govori i o zaštiti prava radnika po okončanju postupka izvanrednog otkazivanja ugovora o radu.

Abstract (english)

In the legislation of the Republic of Croatia, labor relations are normatively regulated by the Labor Law (lex generalis), international treaties harmonized with the Constitution, and other by-laws. During the duration of the employment, there is a possibility of serious and difficult circumstances occurring due to which one of the parties to the employment contract considers that the employment contract should be terminated, these circumstances have arisen such that the party is not reasonably expected to terminate upon expiry. The subject of this paper is institute of extraordinary termination of the employment contract, while the aim of the paper is to show the peculiarities related to the extraordinary termination of the employment contract. In the first part of the paper, attention is focused on the legally prescribed ways of terminating the employment contract, while in the second part of the paper, attention is focused on one of the ways of terminating the employment contract - dismissal. Furthermore, the third part of the paper contains characteristics of the extraordinary termination of the employment contract, where attention is directed to the legal regulation of that institute, the circumstances under which the extraordinary termination of employment becomes legal, and the extraordinary procedure. Also, in this part of the paper, the protection of workers' rights is discussed after the termination of the extraordinary cancellation of the employment contract.
