Abstract

Ovaj rad prikazuje razvoj i osnovne karakteristike rimskog cognitio extra ordinem. Njegov naziv implicira da je to isprva bio izniman postupak koji je postepeno, jačanjem carske dikatature, u 3.st.n.e. postao redovan postupak. Nestala je dvostadijska sturktura karakteristična za ordo iudiciorum privatorum kao i mogućnost biranja suca. Postupak je sada u cjelosti provodio sudac – državni službenik, koji je sam spoznavao (kognoscirao) i istraživao sporni slučaj te donosio presudu koja se izvršavala uz sudjelovanje državnih oragana,čime je pravosuđe postalo državno. Veće sudjelovanje državnih oragana očituje se i prilikom pozivanja tuženika pred sud. Uveo se institut prizivanja (appellatio). Paraleleno se dogodila i transformacija rimskog „sistema akcija“ u „sistem subjektivnih prava“ što je bliže današnjem pojmu tužbe. Iako se kognicijski postupak razlikuje od suvremenog građanskog postupka, neke njegove karakteristike postle su, posredstvom općeg prava, podloga modernom postupku.

Abstract (english)

This paper displays the development and basic characteristics of the roman cognitio extra ordinem. Its name implies that it was at first an exception which gradually became regular procedure in 3rd century. Gone was the two-part structure characteristic for the ordo iudiciourm privatorum, as was the ability to choose the judge. The procedure was now entirely led by a single judge – civil servant who investigated the disputed case and rendered a verdict, which then executed with participation of state authorities, thus making the judiciary state domain. The greater participation of the state authorities is also visible in the summoning of the defendant before the court. Institute of appeal was introduced. At the same time happened the transformation of the Roman "system of actions" into a "system of subjective rights", which made it closer to today's notion of a lawsuit. Although the cognitive procedure differs from the contemporary civil procedure, some of its characteristics became, by way of common law, basis for the modern procedure.
