Abstract

Velika novost u hrvatskom parničnom postupku je uvođenje sustava elektroničke komunikacije. Svrha uvođenja tehnologije u sudske postupke ogledava se u tendenciji zakonodavca da ubrza postupak i poveća njegovu kvalitetu, posebice s aspekta sudskih troškova i pristupa sudovima. Elektronička komunikacija sastoji se od komunikacije između stranaka i suda (podnesak) te suda i stranaka (dostava). Ovaj rad prezentirat će sastavne dijelove tog sustava i tehnološke novote koje ga prate, poput elektroničke isprave i elektroničkog potpisa. Obradit će se novele Zakona o parničnom postupku koje su dovele do sustava koji imamo danas i povezati komparativni modeli nekih zemalja kako bismo utvrdili u kakvoj smo poziciji u odnosu na druge.

Abstract (english)

The great novelty in Croatian civil procedure is introduction of the electronic communication. The purpose of technology implementation in court procedures is reflected by the lawmakers tendency to speed up those procedures and amp up the quality, especially from the aspect of costs and court access. Electronic communication consists of communication between the parties and the court (submission) as well as the court and the parties (service). This paper will present all the main components of the system and subsequent technological novelties, such as electronic documents and electronic signatures. We will follow the amendments of the “Civil Procedure Act” (hr. “Zakon o parničnom postupku”) which led to the system that we have today and compare the Croatian model to the ones of other countries in order to see our standings in comparison to other parties.
