Abstract

Otkaz ugovora o radu posebno zaštićenim kategorijama radnika predstavlja specifično pravno područje. Zakonodavstvo razlikuje apsolutnu i relativnu zaštitu radnika od otkaza. Apsolutna zaštita odnosi se na trudnice, roditelje, posvojitelje, radnike koji su privremeno ili trajno nesposobni za rad, te one koji izvršavaju dužnosti u obrani zemlje. Ove kategorije uživaju potpunu zaštitu od otkaza, uz određene iznimke propisane zakonom. Relativna zaštita uključuje radnike čije je radno mjesto povezano s djelovanjem radničkog vijeća, sindikalnih organizacija i procesima suodlučivanja. Iako njihov ugovor može biti otkazan, postupak je strože reguliran i zahtijeva prethodno savjetovanje ili suglasnost radničkog vijeća. U slučaju nedopuštenog otkaza, radnici imaju pravo na pravnu zaštitu putem zahtjeva za zaštitu prava, sudskih postupaka, vraćanja na rad ili naknade plaće, kao i mogućnosti sudskog raskida ugovora. Pravni mehanizmi osiguravaju jednakost i pravednost u radnim odnosima, smanjujući rizik od neopravdanih otkaza posebno zaštićenim kategorijama radnika.

Abstract (english)

The termination of employment contracts for specially protected categories of workers is a specific legal area. Legislation distinguishes between absolute and relative protection against contract termination. Absolute protection applies to pregnant women, parents, adoptive parents, workers who are temporarily or permanently incapacitated for work, and those performing duties in national defense. These categories enjoy full protection from contract termination, with certain exceptions prescribed by law. Relative protection includes workers whose employment is linked to the activities of works councils, trade unions, and co-decision-making processes. Although their contracts may be terminated, the procedure is more strictly regulated and requires prior consultation or approval from the works council. In cases of unlawful contract termination, workers have the right to legal protection through claims for the protection of rights, court proceedings, reinstatement, or compensation, as well as the possibility of judicial termination of the employment contract. Legal mechanisms ensure equality and fairness in labor relations, reducing the risk of unjustified dismissals for specially protected categories of workers.
