Abstract

Rad analizira razvoj odnosa između zakonodavne i izvršne vlasti u Republici Hrvatskoj tijekom
donošenja prvog Ustava i u prvim godinama hrvatske neovisnosti, posebno se osvrćući na
pravne i ustavne okvire koji su definirali uloge i ovlasti Sabora kao zakonodavnog tijela te
Vlade kao izvršnog organa. U središtu analize nalazi se uloga zakonodavne delegacije, putem
koje je Vlada dobila ovlast donošenja uredbi sa na temelju zakonodavne delegacije, te se
istražuje način i učestalost primjene ovih uredbi u praksi. Kvantitativna i kvalitativna analiza
uredbi pruža temelj za zaključke o mjerama i opsegu korištenja zakonodavne delegacije, kao i
o utjecaju takvog postupanja na diobu vlasti.
Rad također razmatra izazove povezane s formiranjem nove države i uspostavom njenih
institucija, pri čemu su političke i pravne okolnosti zahtijevale prilagodbu tradicionalnih načela
diobe vlasti. U tom kontekstu, opisuje se i polupredsjednički sustav vlasti uveden Božićnim
ustavom iz 1990. godine, analizirajući na koji je način taj model vlasti ograničavao ravnotežu
između zakonodavne i izvršne grane. Osim opisa pravnog okvira, rad istražuje društvene i
političke prilike toga razdoblja, koje su često dovodile do napetosti između Sabora i Vlade te
utjecale na samostalnost zakonodavne vlasti. Kroz analizu povijesnih i institucionalnih
aspekata, rad nudi pregled ključnih izazova s kojima se suočavala nova država, s naglaskom na
važnost održavanja ravnoteže među granama vlasti za očuvanje demokratskih standarda i
vladavine prava.

Abstract (english)

The paper analyzes the development of the relationship between the legislative and executive
branches in the Republic of Croatia during the adoption of the first Constitution and the early
years of Croatian independence, with a particular focus on the legal and constitutional
frameworks that defined the roles and powers of the Parliament as the legislative body and the
Government as the executive authority. The central analysis is on the role of legislative
delegation, through which the Government received the authority to issue decrees based on
legislative delegation, examining the manner and frequency of applying these decrees in
practice. A quantitative and qualitative analysis of the decrees provides a foundation for
conclusions on the measures and extent of legislative delegation usage, as well as the impact of
this practice on the separation of powers.
The paper also considers challenges associated with forming a new state and establishing its
institutions, where political and legal circumstances required an adaptation of traditional
principles of power separation. In this context, the semi-presidential system of government
introduced by the Christmas Constitution of 1990 is described, analyzing how this model
affected the balance between the legislative and executive branches. Beyond the legal
framework, the paper examines the social and political conditions of the period, which often
led to tensions between the Parliament and the Government and influenced the autonomy of the
legislative branch. Through an analysis of historical and institutional aspects, the paper offers
an overview of the key challenges faced by the new state, emphasizing the importance of
maintaining a balance among the branches of power to preserve democratic standards and the
rule of law.
