Abstract

Rad obrađuje razvoj instituta kanonske ženidbe i civilnog braka s obzirom na njihovu povezanost s uređenjem braka prema rimskom privatnom pravu. Stoga su tema i cilj rada prikazivanje tih dvaju vrlo važnih instituta u svjetlu rimskopravnog uređenja. Kanonska ženidba i civilni brak su zasebni instituti. Imaju svoja vlastita obilježja, povijest, načine sklapanja odnosno uspostave, postupke prestanka i razrješenja. Ipak, zajedničko im je da potječu od rimskog privatnog prava. Rimsko privatno pravo nije uređivalo samo rimski brak već i neke druge trajne zajednice. Još se u starom Rimu na brak gledalo kao na nešto posebno, od velikog značaja. Bračno pravo je održavalo bit društva tako što je oslikavalo osnovna načela i temeljne vrijednosti na kojima je rimsko društvo, u određenim etapama svojega razvoja, počivalo.

Abstract (english)

The article deals with the development of the institute of canonical wedding and civil marriage considering their connection with the regulation of marriage according to Roman private law. Therefore, the topic and goal of the article are the presentation of these two very important institutes in the light of the Roman legal system. Canonical wedding and civil marriage are separate institutes. They have their own characteristics, history, methods of assembly or establishment, termination and dissolution procedures. However, they have in common that they originate from Roman private law. Roman private law regulated not only Roman marriage but also some other permanent unions. Back in ancient Rome, marriage was seen as something special, of great importance. Marriage law maintained the essence of society by reflecting the basic principles and fundamental values on which Roman society, in certain stages of its development, rested.
