Abstract

Posebni postupci davanja azila su specifični pravni instituti u okviru sustava azila. U hrvatskom zakonodavstvu uređeni su Zakonom o međunarodnoj i privremenoj zaštiti te uključuju: ubrzani postupak, postupanje na granici ili u tranzitnom prostoru, odbacivanje zahtjeva ili naknadnog zahtjeva, sigurnu zemlju podrijetla, sigurnu treću zemlja, europsku sigurnu treću zemlja, naknadni zahtjev te preseljenje, humanitarni prihvat i premještanje. Doprinose poboljšanju učinkovitosti postupka jer omogućavaju fleksibilnost i veću brzinu postupka, no njihova primjena sa sobom nosi određene rizike. Naime, postoji opasnost da se ovi postupci koriste kao alat za sustavno kršenje prava tražitelja azila. Zbog toga je važno da zakonodavni okvir koji regulira postupke azila bude predmet konstantne prilagodbe aktualnim zbivanjima kako bi se mogao nositi s novim izazovima i promjenama u međunarodnim i nacionalnim kontekstima. U skladu s tim ovaj rad će nastojati pružiti sveobuhvatan pregled i kritički osvrt na aktualne odredbe i prakse u području posebnih postupaka davanja azila, s posebnim naglaskom na ubrzani postupak te postupanju na granici ili u tranzitnom prostoru ponajviše radi njihove kompleksnosti i relevantnosti u praksi.

Abstract (english)

Special asylum procedures are specific legal institutions within the asylum system. In Croatian legislation, they are regulated by the Law on International and Temporary Protection and include: accelerated procedure, procedures at the border or in transit zones, dismissal of an application or subsequent application, safe country of origin, safe third country, European safe third country, subsequent application, as well as resettlement, humanitarian reception, and relocation. These procedures contribute to the improvement of process efficiency as they allow for flexibility and faster processing times. However, their implementation carries certain risks. Namely, there is a danger that these procedures may be used as a tool for systematically violating the rights of asylum seekers. Therefore, it is crucial that the legislative framework regulating asylum procedures is subject to constant adaptation to current events so it can be able to address new challenges and changes in international and national contexts. Accordingly, this paper aims to provide a comprehensive overview and a critical analysis of current provisions and practices in the area of special asylum procedures, with a particular focus on accelerated procedures and procedures at the border or in transit zones, primarily due to their complexity and relevance in practice.
