Abstract

Ovaj diplomski rad sadrži predstavljanje kaznenih djela zlouporabe položaja i ovlasti i nezakonitog pogodovanja, kako kroz njihovu zakonsku definiciju tako i kroz sudsku praksu Vrhovnog suda Republike Hrvatske te kroz znanstvene i stručne članke. U radu se osim Kaznenog zakona analiziraju i primjenjive odredbe drugih zakona, poglavito Zakona o javnoj nabavi i Zakona o sprječavanju sukoba interesa. Osim samih kaznenih djela, u početku rada predstavlja se pojam službene osobe ili odgovorne osobe koja može biti eventualni počinitelj.

Abstract (english)

This graduate thesis contains a presentation of the criminal acts of abuse of position and authority and illegal favoritism, both through their legal definition and through the judicial practice of the Supreme Court of the Republic of Croatia, as well as through scientific and professional articles. In addition to the Criminal Code, the paper analyzes the applicable provisions of other laws, especially the Law on Public Procurement and the Law on Prevention of Conflicts of Interest. In addition to the criminal acts themselves, at the beginning of the paper, the concept of an official or a responsible person who can be a possible perpetrator is presented.
