Abstract

U ovome radu nastoji se prikazati arbitraža, to jest arbitražni postupak koji se provodi prema UNCITRAL-ovim arbitražnim pravilima, originalno osmišljenima za ad hoc arbitražu. Rad u uvodnom dijelu daje osvrt na pojmove vezane uz arbitražno pravo, Komisiju Ujedinjenih naroda za međunarodno trgovačko pravo (UNCITRAL) kao i nastanak njegovih arbitražnih pravila. Glavnina rada bavi se detaljnom analizom najnovije verzije UNCITRAL-ovih arbitražnih pravila u kojem se analiziraju najvažnije norme pravila prema odjeljcima, s osvrtom na relevantna teorijska razmatranja. Na kraju, ovaj rad se dotiče posebnih UNCITRAL-ovih Ubrzanih arbitražnih pravila te se daje prikaz prakse kroz dva arbitražna postupka provedena prema UNCITRAL-ovim pravilima.

Abstract (english)

This paper aims to present arbitration, specifically the arbitration procedure conducted according to the UNCITRAL Arbitration Rules, originally designed for ad hoc arbitration. The introductory part of the paper provides an overview of terms related to arbitration law, the United Nations Commission on International Trade Law (UNCITRAL), and the creation of its arbitration rules. The main part of the paper deals with a detailed analysis of the latest version of the UNCITRAL Arbitration Rules, analyzing the most important provisions of the rules by sections, with reference to relevant theoretical considerations. Finally, this paper addresses the specific UNCITRAL Expedited Arbitration Rules and illustrates application through two arbitration procedures conducted according to the UNCITRAL rules.
