Abstract

Sportsko arbitražno sudište ( Court of Arbitration for Sport, CAS) je međunarodno arbitražno sudište nadležno za administriranje sporova povezanih sa sportom putem arbitraže ili medijacije. Predstavlja vrhunac svjetskog sistema u rješavanju sporova povezanih sa sportom bilo u pogledu nacionalnih ili međunarodnih sportskih pitanja. Iako je osnovano kao unutarnje tijelo Međunarodnog olimpijskog odbora, neovisan je o bilo kakvoj sportskoj organizaciji. CAS je pravovaljano arbitražno sudište, kako je i potvrđeno odlukama švicarskog Vrhovnog federalnog suda. CAS djeluje na temelju vlastitih pravnih propisa prilagođenih specifičnim potrebama sporta, stvarajući na jedan indirektan način Lex sportiva u međunarodnim sportskim odnosima. Najvažniji i osnovni pravni izvor za djelovanje sudišta je CAS Kodeks.
CAS čine odjeli koji su nadležni za administriranje određenih vrsta sporova, u određenom stupnju i prema točno određenim pravilima primjenjivim za onu vrstu postupka kojeg pojedini odjeli provode. To su Redovni arbitražni odjel, Žalbeni arbitražni odjel, Odjel u borbi protiv dopinga. Pored ova tri glavna odjela, osnivaju se i ad hoc odjeli. Jedino dopušteno pravno sredstvo u pobijanju CAS arbitražnog pravorijeka u Švicarskoj je tužba za poništaj arbitražnog pravorijeka. Ona se jedino i isključivo može podnijeti švicarskom Vrhovnom federalnom sudu. Temeljne odredbe koje upućuju na nadležnost ovog suda u ispitivanju međunarodnih arbitražnih pravorijeka donesenih u Švicarskoj sadržane su u PILA-i. U drugim zemljama je potrebno pak provesti postupak priznanja i izvršenja stranih arbitražnih odluka, u kom slučaju se primjenjuje Newyorška konvencija o priznanju i izvršenju stranih arbitražnih odluka iz 1958.

Abstract (english)

The Court of Arbitration for Sport (CAS) is an international arbitration court responsible for administering sports-related disputes through arbitration or mediation. It represents the pinnacle of the world system in resolving sports-related disputes, whether in terms of national or international sports matters. Although it was established as an internal body of the International Olympic Committee, it is independent of any sports organization. CAS is a valid arbitral tribunal, as confirmed by the decisions of the Swiss Supreme Federal Court. CAS operates on the basis of its own legal regulations adapted to the specific needs of sport, creating in an indirect way the Lex sportiva in international sports relations. The most important and basic legal source for the operation of the court is the CAS Code.
The CAS comprises of divisions which are responsible for administering certain types of disputes, to a certain extent and according to precisely defined rules applicable to the type of procedure that certain division carry out. These are: The Ordinary Arbitration Division, The Appeals Arbitration Division, and The Anti-Doping Division. Beside to these three main divisions, ad hoc divisions are also established. The only legal remedy allowed to challenge a CAS arbitral award in Switzerland is an action to set aside. It can only and exclusively be submitted to the Swiss Federal Supreme Court. The fundamental provisions, referring to the jurisdiction of this court in challenging international arbitral awards made in Switzerland, are contained in the Swiss Private International Law Act. In other countries, it is necessary to carry out the procedure for the recognition and enforcement of foreign arbitral awards, in which case the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards from 1958 is applied.
