Abstract Moj zadatak tijekom pisanja završnog rada bio je objasniti pravne institute kao što su suvlasništvo i razvrgnuće suvlasništva, kako se ostvaruje pravo na razvrgnuće, načini putem kojih se može razvrgnuti suvlasnička zajednica i koji su pravni učinci razvrgnuća. Pravni institut suvlasništva definira se kao vlasništvo više osoba na istoj fizički nepodijeljenoj stvari po dijelovima koji su alikvotno (idealno) određeni. Razvrgnuće se definira kao prestanak dosadašnjeg pravnog odnosa i uspostavu novog i drugačijeg koji proizlazi iz onog koji razvrgnućem nestaje. Suvlasništvo i razvrgnuće suvlasničke zajednice uređeno je Zakonom o vlasništvu i drugim stvarnim pravima. Postoje mnogi zakoni koji, također, uređuju razvrgnuće suvlasničke zajednice, a to su, primjerice, Zakon o zemljišnim knjigama, Zakon o nasljeđivanju, Obiteljski zakon. Institut razvrgnuća suvlasničke zajednice temelji se na činjenici da nitko nije obvezan biti u suvlasničkoj zajednici. Svaki suvlasnik ima pravo na razvrgnuće suvlasničke zajednice. Pravo na razvrgnuće je nezastarivo pravo odnosno vremensko trajanje suvlasničke zajednice ovisi o volji svakog suvlasnika. Razvrgnuće suvlasničke zajednice može se zahtijevati u bilo koje doba. Razlikuju se dva načina ostvarivanja prava na razvrgnuće suvlasništva, a to su dobrovoljno i sudsko razvrgnuće. Dobrovoljno razvrgnuće je razvrgnuće kada su suvlasnici sporazumni da se provede razvrgnuće i kada su suvlasnici sporazumni o predmetu diobe i načinu diobe. Sudsko razvrgnuće je kada sporazum suvlasnika ne postoji te se suvlasništvo razvrgava jednostrano. Postupak razvrgnuća suvlasništva provodi se prvenstveno u izvanparničnom postupku. U hrvatskom pravnom uređenju postoje sljedeći načini razvrgnuća, a to su: fizička dioba, geometrijska dioba, civilna dioba, razdioba više stvari po ekvivalentu, razvrgnuće isplatom i razvrgnuće uspostavom etažnog vlasništva. Način razvrgnuća se može utvrditi ili sporazumnim ili sudskim putem. Način razvrgnuća treba biti u granicama mogućega i dopuštenoga. Pravni učinci razvrgnuća suvlasništva su nastanak individualnog vlasništva, a prestanak suvlasništva, odgovornost za materijalne i pravne nedostatke te status tuđih prava nakon razvrgnuća.
Abstract (english) My task during the writing of the final thesis was to explain legal institutes such as co-ownership and dissolution of the co-ownership, how the right to dissolution is exercised, the ways through which the co-ownership community can be dissolved and what are the legal effects of dissolution. Legal institute of co-ownership is defined as the ownership of several persons on the same physically undivided thing in aliquots (ideally determined parts). Dissolution is defined as the termination of the current legal relationship and the establishment of a new and different one that derives from the termination. Co-ownership and dissolution of co-ownership community is regulated by the Ownership and Other Proprietary Rights Act. There are many Acts that regulate the dissolution of co-ownership community, such as the Land Registration Act, the Inheritance Act, the Family Act, etc. The Institute of dissolution of co-ownership community is based on the fact that no one is obliged to be in co-ownership community. Each co-owner has the right to dissolve the co-ownership community. The right to dissolution is imprescriptible right, i.e. there is no timeframe for the duration of co-ownership. The duration depends on the will of each of the co-owner. The dissolution of a co-ownership community can be required at any time. There are two ways of exercising the right to dissolve co-ownership: voluntary and judicial dissolution. Voluntary dissolution is a dissolution when all co-owners are consensual to carry out the dissolution and when the co-owners are consensual about the subject and the method of division. Judicial dissolution is when there is no agreement of the co-owners and co-ownership dissolves unilaterally. The procedure of the dissolution of co-ownership is carried out primarily in non-contentious proceedings. In the Croatian legal system, there are the following ways of dissolution: physical division, geometric division, civil division, dissolution of several things by equivalence, dissolution by payment and dissolution by the establishment of condominium ownership. The method of dissolution can be determined either by agreement or through court. The method of dissolution should be within the limits of what is possibility and within the law. The legal effects of the dissolution of co-ownership are the emergence of individual property, and the termination of co-ownership, responsibility for material and legal defects and the status of other people’s rights after dissolution.
