Abstract

U radu se uspoređuje radno i službeničko pravo u Republici Hrvatskoj te se analiziraju njihovi ključni aspekti. Radno pravo regulira odnose između poslodavaca i radnika, dok službeničko pravo uređuje odnose između državnih službenika i države. Iako se na prvi pogled čini da su ova dva pravna područja vrlo slična, postoje značajne razlike u njihovim pravnim okvirima. Definicija radnog prava kompleksna je, a kroz godine njezinog proučavanja najviše se ističu razlike oko razumijevanja i shvaćanja pojma radnog odnosa koji je važan za shvaćanje same materije radnog prava. Shvaćanje radnog prava ovisi o predmetu proučavanja te o vladajućim odnosima u društveno-političkoj pravnoj i znanstvenoj realnosti. Radno pravo ovisi o dominantnoj društvenoj skupini, odnosno državi i njezinom društvu jer u njoj djeluje tako da i njegova definicija ovisi o tome kako će je odrediti vladajuća struktura pravno-političkog i ekonomskog sustava određene države. Dugotrajno i opravdano vodile su se mnoge rasprave i iznosile teorije o tome je li službeničko pravo posebna grana prava ili njegova podgrana. Pravna regulacija službeničkih odnosa ovisi o razvoju države i značenje koje država pridaje tim odnosima. Za razliku od drugih radnih odnosa, zahtjev za posebnom regulacijom statusa državnih službenika izraženiji je kod službeničkih odnosa jer oni imaju izraženije značenje za državu koja se u tom odnosu nalazi u ulozi poslodavca, a veliko značenje imaju i za građane na čiji utjecaj mogu imati državni službenici koji postupaju u ime države. Postoje različite definicije službeničkog prava i službeničkog odnosa od zemlje do zemlje, a iz definicija oblikovali su se jedinstveni modeli koji su određivali krug državnih službenika svake zemlje. Za nastanak radnog odnosna potrebni su osnovni elementi koji čine sastavnicu od njegovog zasnivanja pa do njegovog prestanka. Osnovna dva elementa koja čine radni odnos su: postojanje potrebe za zasnivanje radnog odnosa i uvjeti za zasnivanje radnog odnosa. Ostali elementi, odnosno sastavnice radnog odnosa jesu: dobrovoljnost, osobnost, naplatnost (oneroznost) i podređenost (subordinacija). Službenički odnos, kao posebni oblik radnog odnosa kako bi bio valjani mora sadržavati sve navedene bitne sastavnice radnog odnosa, ali radi svoje specifičnosti i posebne prirode posla obuhvaća dodatne dvije sastavnice: preuzimanje dužnosti i stjecanje prava te profesionalnost.

Abstract (english)

In this paper I compared labor law with civil service law in the republic of Croatia and analyzed its key aspects. Labor law regulates relationship between employer and employee and civil service law guverns relationships between civil servants and the country. Maybe at first it seems that these two legal areas are very similar, but there are key differences in their legal frameworks. Definition of labor law is complex, throught the years of studying labor law, the key diffirences that stand out are that of undrestanding the concept of employment relationship which is important to understanding the matter itself of labor law. The understanding of labor law depends on the subject of study and guverning relations in socio-political legal and scientific reality. Labor law depends on dominant social group, relatively the country itself because it acts in it. Its definition depends on that how it will be determined by the ruling structure of the legal-political and economic system of a given state. For a long time and justified, many debates and theories were put forward about whether civil service law is a special branch of law or its sub-branch. The legal regulation of official relations depends on the development of the country and the meaning that the country attaches to these relations. In contrast to other employment relationships, the demand for special regulation of the status of civil servants is more pronounced in the case of civil servant relations, because they have a more pronounced meaning for the state, which is in the role of employer in that relationship, and they also have a great significance for citizens on whom civil servants can influence who act on behalf of the state. There are different definitions of civil service law and civil servant relations from country to country and from definitions unique models were shaped wich determined the circle of civil servants for every country. Basic elements are necessary for the creation of an employment relationship, which form a component from its establishment until its termination. The basic two elements for employment relationship are: a need for starting an employment relationship and the conditions for starting an employment relationship. Other elements of the employment relationship are: willingness, personality, chargeability and subordination.
Civil servant relationship, as a special form of employment, in order to be valid, must contain all the listed essential components of the employment relationship.
