Abstract

Stupanjem na snagu Zakona o upravnim sporovima 1. siječnja 2012. otvorena je mogućnost pokretanja upravnog spora radi ocjene zakonitosti općeg akata jedinice lokalne i područne (regionalne) samouprave, pravne osobe s javnim ovlastima i pravne osobe koja obavlja javnu službu. U ovom radu obrađuje se tema kontrole zakonitosti prostornih planova kao najsloženijih općih akata jedinica lokalne i regionalne samouprave. U prilog navedenom govori činjenica kako se zahvati u prostoru jedinica lokalne i regionalne samouprave mogu provoditi samo u skladu s prostornim planovima. U uvodnom dijelu daje se uvid u važnost prostornog planiranja i postupak donošenja prostornih planova, zatim se određuje pojam općeg akata i prostornih planova kao općih akata koji su predmet upravnog spora. U zaključnom dijelu obrađuje se postupak kontrole zakonitosti općih akata te daje pregled sudske prakse Visokog upravnog suda u postupcima prostornog planiranja.

Abstract (english)

Adoption of the Administrative Disputes Act on January 1, 2012, has opened the possibility of initiating an administrative dispute regarding the legality of general acts of local and regional self-government units, legal entities with public powers and legal entities performing public service. This paper deals with the topic of control of the legality of spatial plans as the most complex general acts of local and regional self-government units. In support of the above, stands the fact that interventions in the area of local and regional self-government units can only be carried out in accordance with spatial plans. The introductory part of this paper provides an insight into the importance of spatial planning and the procedure for adopting spatial plans, then defines the concept of general act and spatial plans as general acts that are the subject of an administrative dispute. The final part of this paper deals with the procedure of the control of the legality of general acts and gives an overview of the case law of the High Administrative Court of the Republic of Croatia in spatial planning procedures.
