Abstract

Dugo se vremena smatralo da je zatvorska kazna pravedan odgovor i upozorenje
po initelju da prestane initi kaznena djela i da je to najefikasniji na in borbe protiv
kriminala. Me utim, s vremenom su sve vi e dolazile do izra aja negativne strane
zatvorske kazne te se u novije vrijeme sve vi e koriste alternative zatvoru, a jedna od
njih je i probacija. Probacija je supervizija po initelja u uvjetima slobode koju
provodi odre eni slu benik suda (nazvan i probacijskim slu benikom).U Hrvatskoj je
probacijska slu ba ustrojena tijekom pregovora o lanstvu Hrvatske u EU. Prvi Zakon
o probaciji donesen je 2009. godine, a prvi probacijski ured Zagreb I otvoren je 2011.
Za cjelovito izvr avanje probacijskih poslova, potrebno je uklju ivanje probacijske
slu be u sve faze kaznenopravnog procesuiranja – od faze prije su enja, faze
odlu ivanja, izvr avanja alternativnih sankcija u zajednici, faze kazne zatvora te
postpenalnog nadzora. Iz analize statisti kih podataka, vidljivo je da se svake godine
broj predmeta na kojima radi probacijska slu ba pove ava te se mo e zaklju iti i da
je potreban sve ve i broj slu benika u probacijskim uredima. U svakom uredu radi
voditelj ureda, probacijski službenici i administrativni djelatnik. U okviru
probacijske službe uglavnom rade socijalni radnici, socijalni pedagozi, psiholozi i
pravnici, a službenike je zbog specifičnosti posla potrebno konstatno educirati.

Abstract (english)

It was long tought that the imprisonment is the most
effective way to fight crime. However, with time, there
were identified negative effects of prison sentence, and
more recently, there is increasing number of prison
alternatives, and one of them is probation. Probation is
the supervision of the perpetrator in terms of freedom
conducted by the designated official of the court (called
the probation officer). In Croatia, probation servise was
established during the negotiations on Croatian
membership in the EU. The first the Probation Act was

passed in 2009 and the first probation office Zagreb I
opened in 2011. For the full execution of probation work,
it is necessary to turn the probation service in all
phases of the criminal justice processing from
the
pretrial
stage, the execution of alternative sanctions
in the community phase, of the imprisonment and for
postcontrol.
The analysis of statistical data shows that
each year the number of cases handled by the probation
service increases and thus be concluded that the required
growing number of employees in the probation offices. Any
probation office has office manager, probation officers
and administrative personnel. Within the probation
service usually work social workers, social pedagogues,
psychologists and lawyers, and because of specific job,they all need to be constantly educated.
