Abstract

U ovom radu dan je prikaz obveznog osiguranja od automobilske odgovornosti, s naglaskom na treće oštećene osobe. Posebno se obrađuju prava trećih osoba i postupak ostvarivanja tog prava uz određene izazove s kojima se mogu susresti prilikom ostvarivanja prava na naknadu štete. Donošenjem Zakona o obveznim osiguranjima u prometu, obvezna osiguranja izdvajaju se u poseban zakon, koji sustavno i samostalno uređuje navedenu materiju. Nadalje, analizirane su odredbe nacionalnog zakonodavstva koje su usklađene s zakonodavstvom Europske unije, koja je području osiguranja od odgovornosti u pogledu upotrebe motornih vozila posvetila posebnu pažnju donošenjem šest direktiva o usklađivanju zakona država članica. Shodno tome, prikazat će se usporedba prava trećih osoba u Republici Hrvatskoj i drugim državama članicama Europske unije. Radi boljeg shvaćanja primjene pojedinih instituta, analizirat će se primjeri iz sudske prakse hrvatskih sudova, sudova država članica Europske unije i Suda pravde EU.

Abstract (english)

This thesis deals with the topic of the compulsory motor liability insurance, with a focus on third injured party. The rights of third parties and the procedure for exercising that right are specifically processed, along with certain challenges that may be encountered when exercising the right to compensation. With the enactment of Compulsory Motor Vehicle Insurance Act, compulsory insurance is separated into a special law, which systematically and independently regulates the said matter. Furthermore, the provisions of national legislation harmonised under European Union legislation, which paid special attention to the area of motor third party liability insurance by adopting six directives on the harmonization of the laws of the Member States, were analyzed. Accordingly, a comparison of the rights of third parties in the Republic of Croatia and other Member States of the European Union will be presented. In order to better understand the application of individual institutes, examples from the case law of Croatian courts, courts of EU member states and the Court of Justice of the EU will be analyzed.
