Abstract

SAŽETAK
U vrijeme osnivanja Ujedinjenih naroda 40.-ih godina prošlog stoljeća trećina je svjetske populacije živjela na područjima koja su bila ovisna o kolonijalnim silama. Međutim, iako je doprinos UN-a procesu dekolonizacije bio značajniji u usporedbi s razdobljem prije Drugog svjetskog rata, misao o okrutnosti takvih režima javila se desetljećima prije njegova osnivanja te su prvi koraci u procesu dekolonizacije učinjeni u okviru Lige naroda. Sam proces je bio obilježen neprestanim sukobima između kolonijalnih sila koje su htjele zadržati postojeće strukture vlasti te protukolonijalnih država koje su bile pokretači promjena unutar Opće skupštine UN-a. Stoga, u ovom je radu dan prikaz različitih povijesnih i pravnih okolnosti koje su bile od najvećeg značaja za proces dekolonizacije, s posebnim naglaskom na djelovanje UN-a. Počevši od Prvog svjetskog rata te mandatnog sustava Lige naroda, u radu su uvodno objašnjene povijesne okolnosti koje su dovele do promjena u kolonijalnim režimima te nastanka dvaju novih instituta unutar UN-a - starateljskog sustava te sustava nesamoupravnih područja. U drugom dijelu, detaljno je opisan sustav starateljstva od početka njegova funkcioniranja pa do prestanka posljednjeg starateljskog područja, a potom je analiziran i tijek procesa dekolonizacije ostalih nesamoupravnih područja. Nadalje, analizirani su najrelevantniji međunarodnopravni akti u odnosnoj tematici, a posebna je pozornost posvećena Povelji UN-a koja je poslužila kao temelj cijelog procesa dekolonizacije. Naposljetku, u radu su opisani i suvremeni problemi u pitanju dekolonizacije s kojima se međunarodna zajednica i danas bavi.

Abstract (english)

When the United Nations was established during the 1940s, a third of the world's population lived in territories that were dependent on colonial powers. Even though the UN's contribution to the process of decolonization was more significant in comparison to the period before the Second World War, the cognizance of the cruelty of colonial regime emerged decades before it's foundation, so the first steps in the process of decolonization were taken under the League of Nations. The process was characterized by constant clashes between colonial powers who wanted to retain the existing power structures on the one hand, and anticolonial states who led the changes in the UN's General Assembly, on the other. This paper will discuss various historical and legal circumstances which were pertinent to the process of decolonization, with an emphasis on the activities of the UN. Starting with the World War I and the League of Nations' mandate system, this paper examines the historical events which led to changes in colonial regimes and the establishment of two institutions under the auspices of the UN – the trusteeship system and non-self governing territories. The second part thoroughly examines the trusteeship system and then focuses on the process of decolonization regarding other non-self governing territories. Furthermore, the author analyzes the most important international legal acts in this context, with special attention given to the UN Charter as a fundamental legal act of the whole process. Finally, the paper examines contemporary challenges which the international community faces today in regards of the process of decolonization.
