Abstract

Ovim radom nastojim objasniti koncept suvereniteta kao esencijalnog atributa države koji u svojoj jezgri sažima pitanje posjednika političke i pravne moći i njezine raspodjele, te kroz prikaz istaknutih teoretičara suvereniteta, evoluciju njegovog sadržaja od izvorno uobličene teorije u 16. stoljeću kada je trebao poslužiti afirmaciji monarhova apsolutizma do suvremenih globalizacijskih procesa koji traže njegovu prilagodbu. Kako se ta evolucija kretala od koncentracije moći ka njenoj podjeli među različitim akterima, to je učinilo da njezin locus ne nalazimo isključivo unutar države, već njenom suverenom voljom biva dijelom prenesen na nove aktere u međunarodnim odnosima. Takav novi akter je i Europska unija kao nov pravni poredak međunarodnog prava čiji unutarnji integracijski proces želim pokazati bitno određenim akomodacijom nadnacionalnog europskog prava i nacionalnih pravnih poredaka kroz dinamičan odnos Suda Europske unije i najviših nacionalnih sudova država članica, s posebnim naglaskom na uzoritu jurisprudenciju njemačkog Saveznog ustavnog suda, objašnjavajući mehanizme koje je ustavno sudovanje razvilo u nastojanju obrane od ex nihilo konstruiranog načela nadređenosti i izravnog učinka europskog prava, te demokratski nelegitimiranog širenja nadležnosti Europske unije.

Abstract (english)

In this paper I aim to explain the concept of sovereignty as an esential atribute of the state which at its core summarizes the question of the holder of political and legal power and the way that this power is distributed, and through presentation of prominent theorists of sovereignty the evolution of its content from the original theory formed in the 16th century in order to serve afirmation of the apsolutism of the monarh all through to contemporary globalization processes that require its adaptation. As this evolution of its content moved from the concentration of power to its division among different actors, it made its locus not exclusively within the state, but by its sovereign will partly transffered to new actors in international relations. Such a new actor is the European Union as a new legal order of international law whose internal integration process I aime to present significantly determined by accomodation of supranational European Union law and national legal orders through a dynamic relation between the Court of justice of the European Union and the highest national tribunals of the member states, with special emphasis on exemplary practise of German Federal Constitutional Cort, explaining the mechanisms developed by the costitutional legal practice in effort to relativise ex nihilo constructed principle of the supremacy of European Union law and the democratically illegitimate expansion of the competences of the European Union.
