Abstract

Za djetetov pravilan emocionalni i fizički razvoj iznimno je važna poticajna i zdrava
okolina. U tome najvažniju ulogu ima obitelj. Ona treba odgovoriti na djetetove
potrebe, pružiti mu potporu i sigurnost, naučiti empatiji te prosocijalnom ponašanju,
osigurati zdravstvenu zaštitu i obrazovanje. S obzirom na to da roditelji svojim
ponašanjem i odgojem utječu na djetetov razvoj, oni mogu ostaviti i negativne
posljedice na dijete ili pak počiniti zanemarivanje ili zlostavljanje. Djeca
predstavljaju skupinu pojedinaca kojima je potrebna posebna zaštita zbog njihove
dobi i nemogućnosti samostalnog života. Zbog svjesnosti zajednice o važnosti
djetetovog odrastanja i pravilnog razvoja, međunarodnim dokumentima i
nacionalnim zakonodavstvom uređen je pravni položaj djeteta. Najvažnijim pravima
se smatraju pravo djeteta na život s roditeljima, pravo na zdravlje, pravo na
obrazovanje, pravo na odgoj, pravo na zaštitu od nasilja. Ukoliko roditelji krše
djetetova prava, državne institucije su obvezne poduzeti mjere obiteljsko pravne
zaštite.

Abstract (english)

A stimulating and healthy environment is extremely important for a child's proper
emotional and physical development. Family, thus, has a crucial role in child’s
development. Family needs to respond to the child's needs, provide support and
safety, teach a child empathy and prosocial behavior as well as to provide a child
with healthcare and education. Since parents influence the child's development
through their behavior and upbringing, they can also have a negative impact on the
child and even neglect or abuse him/her. Furthermore, children represent a group of
individuals who need special protection because of their age and their inability to
live independently. Due to the aforementioned and the community’s awareness of the
importance of the child's growth and proper development, the legal status of the
child is regulated by international documents as well as national legislation. Child’s
rights which are considered to be the most important ones are the right of the child
to live with parents, the right to health, the right to education, the right to
upbringing, the right to protection from violence. If parents violate the child's rights,
state institutions are obliged to take measures of family law protection.
